Terms & Conditions for the DYOX Online Shop

§ 1 Scope

  1. These Terms & Conditions govern all contracts for the sale of goods and digital content concluded between us and you as a customer via our online shop.

  2. A “consumer” is any natural person who enters into a legal transaction for purposes that are predominantly outside their trade, business or profession.

  3. Any terms and conditions of the customer that differ from or supplement these Terms & Conditions shall not form part of the contract unless we have expressly agreed to them in writing.


§ 2 Contracting party

§ 3 Offer and conclusion of contract

  1. The product presentations in our online shop do not constitute a legally binding offer, but an invitation to place an order (“invitatio ad offerendum”).

  2. You can add products to your cart without obligation and adjust your entries at any time before submitting your binding order.

  3. By clicking the “Buy now” (or similarly labelled) button, you submit a binding offer to purchase the products in your cart.

  4. The contract is concluded only when we expressly accept your order (e.g. by order confirmation via e-mail) or dispatch the goods to you.

  5. We do not store the contract text in a way that is permanently accessible to you. You can print or save the order overview directly after sending the order and use the order confirmation e-mail as your record.


§ 4 Prices, taxes and shipping costs

  1. The prices shown in the shop at the time of ordering apply. All prices are stated in Euro (EUR).

  2. Unless otherwise indicated, prices include the applicable German statutory VAT. Depending on your country of delivery, the final tax calculation may change during checkout. The total amount shown in the checkout is decisive for your order.

  3. Any shipping costs will be shown separately during the order process before you submit your order.

  4. For deliveries outside the European Union, additional customs duties, taxes and fees may apply. These are not included in the prices and are to be borne by you.


§ 5 Delivery, production times and availability

  1. Delivery is made to the delivery address specified in the order process. The available countries of delivery are indicated in the shop.

  2. Any stated production and delivery times are indicative and not binding, unless we expressly confirm a fixed date in writing.

  3. Some DYOX objects are produced as editions in small batches, prototypes or pre-orders. In such cases, this is indicated in the product description. Production and dispatch may start only after order confirmation and receipt of payment.

  4. If individual products are not available after the contract has been concluded for reasons beyond our control (e.g. material shortages, discontinuation of an edition), we will inform you without undue delay and refund any payments already made.


§ 6 Payment methods

  1. Available payment methods (e.g. PayPal, credit card, other payment service providers) are displayed during the checkout process. We reserve the right to exclude certain payment methods in individual cases.

  2. Unless otherwise agreed, the purchase price is due immediately upon conclusion of the contract.

  3. Payment processing may be carried out via external payment service providers. In such cases, the terms and conditions and privacy policies of the respective payment service providers apply in addition.


§ 7 Retention of title

The goods remain our property until the purchase price has been paid in full.


§ 8 Right of withdrawal (consumers)

  1. If you are a consumer, you generally have a statutory right of withdrawal of 14 days when purchasing via our online shop.

  2. Details of your right of withdrawal, its consequences and how to exercise it are set out in our separate
    “Refunds & Returns / Right of Withdrawal” page on dyo-x.com, which forms part of this information.

  3. The right of withdrawal may be excluded or expire in certain cases, in particular for

    • goods made to your specifications or clearly personalised,

    • digital content not supplied on a tangible medium, once we have begun performance with your express consent and after you acknowledged that you lose your withdrawal right once performance has begun.


§ 9 Returns

  1. In the event of a withdrawal, you must return the goods to us at your own cost, unless otherwise agreed. Details are set out in our Refunds & Returns page.

  2. Please pack the goods carefully to avoid transport damage. Using the original packaging is recommended where possible.


§ 10 Special provisions for prototypes, small batches and editions

  1. DYOX develops objects from parametric systems, which are sometimes manufactured as prototypes, small batches or numbered editions. Minor variations in colour, surface, material texture (e.g. wood grain) or visible signs of manual processing are typical characteristics of this manufacturing method and do not constitute defects.

  2. Product images in the shop show examples of the respective edition. Differences between the product images and the delivered item, caused by screen settings or normal production tolerances, are technically unavoidable and do not give rise to warranty claims.

  3. In the case of kits (DIY sets), you are responsible for assembly according to the instructions supplied. We accept no liability for damage caused by improper assembly, modification of the structure or use contrary to the intended purpose.


§ 11 Warranty (statutory liability for defects)

  1. Your statutory rights regarding defective goods (legal warranty) apply.

  2. In the event of a defect, you are initially entitled to cure (repair or replacement). If cure fails, you may reduce the purchase price or withdraw from the contract, subject to the statutory requirements.

  3. The statutory limitation period for warranty claims is generally two years from delivery of the goods.


§ 12 Liability

  1. We are liable without limitation for damages arising from injury to life, body or health caused by an intentional or negligent breach of duty by us, our legal representatives or vicarious agents.

  2. We are also liable without limitation for damages caused by intentional or grossly negligent breaches of duty by us, our legal representatives or vicarious agents.

  3. In cases of simple negligence, we are only liable for breaches of essential contractual obligations (cardinal obligations). In such cases, our liability is limited to the foreseeable damage typical for this type of contract.

  4. The above limitations of liability do not apply if we have fraudulently concealed a defect or assumed a guarantee for the quality of the goods. The provisions of the German Product Liability Act remain unaffected.


§ 13 Copyright and digital content

  1. All content displayed in the shop – in particular designs, texts, images, technical drawings, files and layouts – is protected by copyright (Tobias Schmid / HANMUT UG (haftungsbeschränkt) or respective rights holders).

  2. By purchasing a physical product, you do not acquire any rights to reproduce the design, technical files or digital assets. In particular, you are not permitted, without our prior written consent, to

    • copy, distribute or sell parameter files, CAD models or plans,

    • reproduce constructions commercially or produce them in series.

  3. When purchasing digital content (e.g. files, configurator outputs), you receive a simple, non-transferable licence for the private or specifically agreed purpose, unless otherwise stated in the product description.


§ 14 Data protection

We process personal data in accordance with the General Data Protection Regulation (GDPR) and the German Federal Data Protection Act (BDSG).

§ 15 Online dispute resolution and consumer dispute settlement

  1. The European Commission provides a platform for online dispute resolution (ODR), which you can access at:

  2. We are neither obliged nor generally willing to participate in dispute resolution proceedings before a consumer arbitration board.


§ 16 Applicable law

  1. These Terms & Conditions are governed by the laws of the Federal Republic of Germany, excluding the UN Convention on Contracts for the International Sale of Goods (CISG).

  2. For consumers, this choice of law applies only insofar as it does not deprive you of the protection afforded by mandatory provisions of the law of the country in which you have your habitual residence.


§ 17 Final provisions

If any provision of these Terms & Conditions is or becomes invalid or unenforceable, this shall not affect the validity of the remaining provisions. The invalid provision shall be replaced by the applicable statutory rule.
